1) Acceptance of Terms

These Terms form a binding agreement between you and Nirogan (“we”, “us”). If you do not agree, do not use the Services. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation.

2) Eligibility & Local Laws

You must be capable of entering a contract under applicable laws. You are responsible for compliance with your local laws and regulations when accessing or using the Services.

3) Not Medical Advice / Emergencies

Information on the Services (including AI Vitals estimates and CDSS cues) is for support and educational purposes only and is not a medical diagnosis, treatment, or a substitute for professional judgment. In an emergency, call your local emergency number immediately.

4) Accounts & Accuracy

  • You agree to provide accurate information and keep it updated.
  • You are responsible for safeguarding your credentials and all activity under your account.
  • We may suspend or terminate accounts that violate these Terms or applicable law.

5) Payments, Fees & Refunds

  • Some features are paid (e.g., teleconsultation at ₹499/consult or subscription plans). Prices may change with notice.
  • Payments are processed through third-party payment providers; their terms may apply.
  • Except where required by law or expressly stated by us in writing, fees are non-refundable.

6) Privacy, ABHA & Consent

Your data is handled as described in our Privacy Notice. Where supported, the Services may integrate with ABDM/ABHA for consent-based sharing. You control when to link or share your records, and you can revoke consents as permitted by ABDM rules.

7) Data Use & Anonymisation

We may use your data to provide and improve the Services, including quality, safety and reliability. Where possible, we apply de-identification or aggregation. We do not sell your personal data.

8) Security

We implement reasonable administrative, technical and physical safeguards. However, no method of transmission or storage is completely secure; use the Services at your own risk and notify us promptly of any suspected unauthorised access.

9) Prohibited Use

  • Reverse engineering, scraping, or interfering with the Services.
  • Uploading harmful code or violating others’ rights or privacy.
  • Using the Services in violation of clinical, privacy or export laws.

10) CDSS & AI Vitals — Safety

CDSS modules and AI Vitals (rPPG) are assistive. They may surface summaries, cues, or estimates and can be inaccurate or incomplete. Clinicians must independently evaluate all outputs. We do not practice medicine or provide medical device functionality.

11) Third-party Services & Links

Links to third-party sites or services are provided for convenience and do not imply endorsement. We are not responsible for their content, policies, or availability.

12) Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

13) Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising out of or in connection with the Services, even if advised of the possibility of such damages.

14) Indemnity

You agree to indemnify and hold us harmless from any claims, losses, liabilities and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.

15) Governing Law & Disputes

These Terms are governed by the laws of India. Subject to applicable law, courts in New Delhi shall have exclusive jurisdiction. Where required or agreed, disputes may be referred to arbitration under applicable Indian arbitration rules.

16) Changes to the Services or Terms

We may modify the Services or these Terms. If changes are material, we will provide reasonable notice (e.g., via the website or email). Continued use after changes means you accept the revised Terms.
